Section 1184E — Social Security Act 1991: Liability of compensation payer or insurer to pay the Commonwealth if there is a contravention of section 1184D

(1) A compensation payer or insurer who contravenes section 1184D is, in addition to being liable under that section, liable to pay to the Commonwealth: (a) if the contravention relates to a notice under section 1182—an amount determined by the Secretary; or (b) if the contravention relates to a notice under section 1184—the recoverable amount specified in the notice. (2) The amount determined by the Secretary under paragraph (1)(a) must not be more than the smallest of the amounts worked out: (a) if the person is not a member of a couple—under subsection 1184A(1), (2) or (4), as the case requires; or (b) if the person is a member of a couple—under subsection 1184A(1), (2), (3) or (4), as the case requires. (3) This section applies in relation to a payment by way of compensation in spite of any law of a State or Territory (however expressed) under which the compensation is inalienable.
