Section 1188 — Social Security Act 1991: Rate reduction under this Part

(1) Subject to subsection (2), if a person’s rate of payment under this Act is to be reduced under this Part because of a payment under a self-employment program (a self-employment program payment), the amount of rate reduction is to be equal to the amount of the self-employment program payment. (2) If: (a) a person’s rate of payment under this Act is to be reduced under this Part because of a self-employment program payment; and (b) the person’s partner’s rate of payment under this Act is also to be reduced under this Part (see subsection 1187(2)) because of the self-employment program payment; the amount of rate reduction for both the person and the person’s partner is to be equal to 50% of the amount of the self-employment program payment. (3) A person’s rate of payment under this Act is not to be reduced below nil under subsection (1) or (2).
