Section 1258 — Social Security Act 1991: Production of authority to depart

(1) If: (a) a departure prohibition order in respect of a person is in force; and (b) the person is about to depart from Australia for a foreign country; and (c) the person’s departure is authorised by a departure authorisation certificate; an officer (within the meaning of the Customs Act 1901), or a member of the Australian Federal Police, may request the person to give a copy of the certificate to the officer or member for inspection. (2) A person commits an offence of strict liability if: (a) an officer (within the meaning of the Customs Act 1901), or a member of the Australian Federal Police, has made a request of the person under subsection (1); and (b) the person refuses or fails to comply with the request. Penalty for contravention of this subsection: 5 penalty units.
