Section 236B — Social Security Act 1991: Subdivision not to apply in certain cases involving simultaneous death

If: (a) either: (i) a lower ADAT score adult and one or more multiple care children die at the same time; or (ii) a lower ADAT score adult and a dependent child of the adult die at the same time; and (b) apart from this subsection and section 243, because of those deaths, a person would continue to qualify for carer payment under section 235 and would be qualified for payments under Subdivision B; and (c) the sum of the carer payments for which the person would continue to qualify under section 235 and any lump sum payable to the person under section 236A is less than the sum of the amounts payable to the person under Subdivision B; the person does not continue to qualify for carer payment under section 235 and no lump sum is payable to the person under section 236A.
