Section 38T — Social Security Act 1991: Revoking a benefit restriction notice

(1) If the AFP Minister or the ASIO Minister has given a benefit restriction notice, that Minister may, by written notice given to the Minister, revoke the benefit restriction notice. (2) The revocation takes effect on the day it is made. (3) The Minister must give a copy of a notice under subsection (1) to: (a) the Secretary of the Department; and (b) the Human Services Secretary. (4) If: (a) a person’s social security payment is cancelled by subsection 38M(2) or a person’s concession card is cancelled by subsection 38M(3); and (b) the AFP Minister or ASIO Minister revokes the benefit restriction notice concerned; the Secretary of the Department must cause reasonable steps to be taken to notify the person of the revocation.
