Section 992J — Social Security Act 1991: Continued carer allowance during bereavement rate continuation period where disabled child dies

(1) If: (a) a person is receiving carer allowance (other than because of this section or section 954B) for a care receiver who is a disabled child or for care receivers who are 2 disabled children; and (b) the disabled child or one of the disabled children dies; and (c) immediately before the child’s death, the child was an FTB child, or a regular care child, of the person; the person is to be qualified for carer allowance during the bereavement rate continuation period as if the child had not died and had received the care and attention referred to in paragraph 953(1)(d) or 953(2)(d) (as the case may be). Note 1: For bereavement rate continuation period see subsection 21(2). Note 2: If a person fails to satisfy paragraph (1)(c), the person may still be qualified for carer allowance for 4 weeks after the death of the child under section 992L. (2) The rate at which the carer allowance is to be paid during the bereavement rate continuation period is the rate at which the allowance was payable to the person immediately before the day on which the child died.
