Section 123YB — Social Security (Administration) Act 1999: Secretary must have regard to the best interests of children

Scope (1) This section applies if: (a) a person (the first person) is subject to the income management regime; and (b) the first person’s income management account has a credit balance; and (c) the person has one or more children. Secretary must have regard to the best interests of children (2) In deciding whether to take action under this Division that results in an amount being debited from the first person’s income management account, the Secretary must have regard to: (a) the best interests of the first person’s children; and (b) such other matters (if any) as the Secretary considers relevant.
