Section 35A — Social Security (Administration) Act 1999: Claims for advance pharmaceutical allowance

(1) A person may only make a claim for advance pharmaceutical allowance if the claim is made in accordance with subsection (2), (3) or (4). (2) A person may make a claim for advance pharmaceutical allowance to be paid in a calendar year if: (a) the person has received an instalment of a social security pension in relation to an instalment period that included 31 December in the previous calendar year; and (b) the claim is lodged within 14 days after the end of that instalment period. (3) A person may make a claim for advance pharmaceutical allowance to be paid in a calendar year if: (a) the person claims a social security pension in that year; and (b) the claim for advance pharmaceutical allowance is lodged: (i) when the claim for the pension is lodged; or (ii) after the claim for the pension is lodged but before that claim is determined. (4) A person may make a claim for advance pharmaceutical allowance to be paid in a calendar year if: (a) the person has been qualified for pharmaceutical allowance for a period (the qualification period) during the calendar year; and (b) the amount spent by the person during the qualification period on the purchase of pharmaceutical benefits is equal to or greater than the total amount that has been paid to the person in the calendar year by way of: (i) pharmaceutical allowance; and (ii) advance pharmaceutical allowance.
