Section 136 — Veterans' Entitlements Act 1986: Application for review—who may make an application

(2) An application for review under Part 4 of Chapter 8 of the MRCA relating to a pension granted to, or claimed for, a veteran, or a dependant of a deceased veteran, may be made: (a) by the veteran or dependant, as the case may be; (b) with the approval of the veteran or dependant, as the case may be, by another person on behalf of the veteran or dependant; (c) in the case of a veteran or dependant, as the case may be, who is unable, by reason of physical or mental incapacity, to approve a person to make an application on his or her behalf—on behalf of the veteran or dependant, by a person approved by the Commission; or (d) in the case of a dependant who is under the age of 18 years, on behalf of the dependant: (i) by a parent or guardian of the dependant; (ii) by another person approved by a parent or guardian of the dependant; or (iii) if there is not a parent or guardian of the dependant alive or willing and able to make, or approve a person to make, such an application on behalf of the dependant—by another person, being a person approved by the Commission. (3) Subsection (2) does not limit the application of section 126 in relation to applications for review under Part 4 of Chapter 8 of the MRCA.
