Section 179 — Veterans' Entitlements Act 1986: Continuance of Commission

(1) The body corporate that was, immediately before the commencement of this Act, in existence, by virtue of section 7 of the Repatriation Act 1920, under the name Repatriation Commission continues in existence, by force of this subsection, under and subject to the provisions of this Act. (2) The Commission: (a) is a body corporate with perpetual succession; (b) shall have a seal; and (c) may sue and be sued. (3) All courts, judges and persons acting judicially shall take judicial notice of the imprint of the seal of the Commission appearing on a document and shall presume that the document was duly sealed. (4) Debts incurred by the Commission in the performance of its functions shall, for all purposes, be deemed debts incurred by the Commonwealth.
