Section 214 — Veterans' Entitlements Act 1986: Delegation by Secretary

(1) The Secretary may, either generally or as otherwise provided by the instrument of delegation, by writing signed by the Secretary, delegate to a person referred to in subsection (4), all or any of the Secretary’s powers under this Act or under the regulations or under any other legislative instrument made under this Act, other than this power of delegation and the power under subsection 4B(1). (2) A power delegated under this section, when exercised by a delegate, shall, for the purposes of this Act or the regulations or the other legislative instrument made under this Act, be deemed to have been exercised by the Secretary. (3) A delegation under this section does not prevent the exercise of a power by the Secretary. (4) The persons to whom a power may be delegated under subsection (1) are any of the following: (a) an APS employee; (b) a public authority established by a law of the Commonwealth; (c) an officer or employee of a public authority referred to in paragraph (b); (d) a person who performs services on behalf of the Department under a contract made between the person and the Commonwealth; (e) an employee of a person referred to in paragraph (d).
