Section 37E — Veterans' Entitlements Act 1986: Who can claim?

(1) A veteran may not claim an invalidity service pension if he or she has reached pension age (within the meaning of subsections 5QB(2), (3), (4) and (5)). (2) Subject to subsection (3), a claim for invalidity service pension must be made by: (a) the veteran who wants to be granted the invalidity service pension; or (b) with the approval of the veteran—another person on the veteran’s behalf. (3) If the veteran is unable, because of physical or mental incapacity, to approve another person to make the claim on his or her behalf, the Commission may approve another person to make the claim.
