Section 55A — Veterans' Entitlements Act 1986: Instalments may be redirected to partner or child
Text of the provision Official document
(1) If: (a) an instalment of a person’s service pension, income support supplement or veteran payment would, but for this section, not be payable because of section 55; and (b) the person has a partner or a child; the Commission may direct that the whole, or a specified part, of the instalment is to be paid to: (c) the partner; or (d) the child; or (e) someone else approved by the Commission. (2) A payment made under paragraph (1)(e) is to be applied for the benefit of the partner or the child. (3) If a payment is made under subsection (1) to the partner or a child of the person who is in gaol or undergoing psychiatric confinement because the person has been charged with an offence, the payment is to be taken, for all the purposes of this Act, to be a payment made to the person in gaol or psychiatric confinement. Note: This subsection has the effect that the person is receiving the service pension or income support supplement on a payday if the instalment for that payday has been wholly or partly redirected under this section: for instance, the person would be eligible for fringe benefits. This person is not eligible for another income support payment.
