Section 57C — Veterans' Entitlements Act 1986: Date of effect of certain review decisions

(1) If the Commission sets aside a decision and substitutes for it a decision: (a) granting a claim for service pension or income support supplement or granting a veteran payment; or (b) increasing the rate of a service pension, income support supplement or a veteran payment; the substituted decision takes effect from a date specified by the Commission. (2) The date specified by the Commission under subsection (1) must not be earlier than the date from which the Commission could have granted the claim or the veteran payment, or increased the rate, when the original decision was made. (3) If the Commission sets aside a decision to suspend a service pension, income support supplement or a veteran payment, the Commission may end the suspension from a date specified by the Commission, which may be a date earlier than the date of the Commission’s decision to set aside the suspension.
