Section 93J — Veterans' Entitlements Act 1986: Prosecution of offences

(1) Subject to subsection (2), an offence against section 93C, 93D or 93E is an indictable offence. (2) A court of summary jurisdiction may hear and determine proceedings in respect of an offence referred to in subsection (1) if the court is satisfied that it is proper to do so and the defendant and the prosecutor consent. (3) Where, in accordance with subsection (2), a court of summary jurisdiction convicts a person of an offence referred to in that subsection, the penalty that the court may impose is imprisonment for a period not exceeding 6 months or a fine not exceeding 10 penalty units.
