Section 12F — Work Health and Safety Act 2011: Interaction with Commonwealth criminal law

Application of the Crimes Act 1914 (1) Section 4AB of the Crimes Act 1914 does not apply to the provisions of this Act. Application of the Criminal Code (2) Strict liability applies to each physical element of each offence under this Act, unless otherwise stated. (3) Section 15.1 of the Criminal Code (extended geographical jurisdiction—category A) applies to an offence against this Act. (4) Part 2.5 of the Criminal Code (which deals with corporate criminal responsibility) does not apply to an offence against this Act. Note: For the purposes of this Act, corporate criminal responsibility is dealt with by Division 4 of Part 13 of this Act.
