Section 245A — Work Health and Safety Act 2011: Offences and the Commonwealth—physical elements

The conduct constituting the physical element of an offence is taken to have been engaged in by the Commonwealth if the conduct is engaged in by: (a) the executive of an agency of the Commonwealth; or (b) one or more authorised persons for the Commonwealth; or (c) one or more persons acting at the direction of or with the express or implied agreement or consent of: (i) an authorised person for the Commonwealth; or (ii) the executive of an agency of the Commonwealth.
