Section 14 — Building Act 2004: Roles of building consent authorities, territorial authorities, and regional authorities in relation to dams

14 Roles of building consent authorities, territorial authorities, and regional authorities in relation to dams (1) The regional authority is responsible for performing functions under this Act relating to a building that is a dam. (2) If a building includes a dam,— (a) the regional authority is responsible for performing functions under this Act relating to the dam; and (b) the building consent authority and territorial authority are responsible for performing functions under this Act relating to the parts of the building that are not a dam. (3) For the purposes of subsection (1) ,— (a) sections 31 to 39 apply (with all necessary modifications) as if every reference in them to a building consent authority or territorial authority included a reference to a regional authority; and (b) sections 40 to 116 (except section 114(2)(c) ), 216 to 218 , 220 to 232 , 276 to 281 , 363A , and 374 apply (with all necessary modifications) as if every reference in them to a building consent authority or territorial authority were a reference to a regional authority. (4) For the purposes of subsection (2) , sections 31 to 116 (except section 114(2)(c) ), 216 to 218 , 220 to 232 , 276 to 281 , 363A , and 374 apply (with all necessary modifications) as if every reference in them to a building consent authority or territorial authority included a reference to a regional authority. (5) The building consent authority and territorial authority must do everything reasonably practicable to liaise with the regional authority in performing functions or duties, or exercising powers, in relation to a building that includes a dam.
