Section 208 — Building Act 2004: Appeals to District Court

208 Appeals to District Court (1) The persons referred to in subsection (2) may appeal to a District Court against— (a) a determination by the chief executive under section 188 ; or (b) the chief executive's decision to— (i) decline to register the person as a building consent authority; or (ii) take any action referred to in section 203 . (2) The persons are,— (a) in the case of an appeal under subsection (1)(a) ,— (i) the applicant for the determination; or (ii) any other party; or (b) in the case of an appeal under subsection (1)(b)(i) , the applicant for registration; or (c) in the case of an appeal under subsection (1)(b)(ii) , the building consent authority concerned. Section 208(1)(b)(i): amended, on 15 March 2008, by section 39(1) of the Building Amendment Act 2008 (2008 No 4). Section 208(2)(c): amended, on 15 March 2008, by section 39(2) of the Building Amendment Act 2008 (2008 No 4).
