Section 28 — Building Act 2004: Limits on certain powers of building consent authority in cases involving bans under section 26

28 Limits on certain powers of building consent authority in cases involving bans under section 26 (1) A building consent authority must not exercise any of the powers specified in subsection (2) if doing so results, or could result, in a person breaching a ban under section 26 . (2) The powers are— (a) to grant a building consent for building work; or (b) to issue a code compliance certificate for building work. (3) However, subsection (2)(b) does not apply if the building consent to which the code compliance certificate relates was granted before the ban under section 26 came into force.
