Section 313 — Building Act 2004: Certificate of Registrar to be conclusive evidence

313 Certificate of Registrar to be conclusive evidence (1) A certificate signed by the Registrar, or any person authorised by the Registrar, in relation to the matters referred to in subsection (2) is for all purposes conclusive evidence, in the absence of proof to the contrary, of those matters specified in the certificate. (2) The matters are— (a) that any person was or was not a licensed building practitioner at any particular time or during any period specified in the certificate; or (b) that any entry in the register is as stated in the certificate; or (c) that the description of building work and building inspection work that a person is licensed to carry out or supervise is as stated in the certificate. (3) The certificate must be dated. Section 313(2)(c): amended, on 15 March 2008, by section 77 of the Building Amendment Act 2008 (2008 No 4).
