Section 324 — Building Act 2004: Service of summons

324 Service of summons (1) A summons may be served— (a) by delivering it personally to the person summoned; or (b) by posting it to the person summoned at that person's usual place of residence. (2) A summons must,— (a) if it is to be served under subsection (1)(a) , be served at least 48 hours before the attendance of the witness is required: (b) if it is to be served under subsection (1)(b) , be served at least 10 days before the attendance of the witness is required. (3) A summons that is posted is treated as having been served when it would have been delivered in the ordinary course of post. Compare: 2002 No 17 s 30
