Section 340 — Building Act 2004: Appeal on question of law

340 Appeal on question of law (1) A party to an appeal to the District Court under this subpart may appeal to the High Court against any determination of law arising in the appeal. (2) The appeal must be heard and determined in accordance with the appropriate rules of Court. (3) Part 4 of the Summary Proceedings Act 1957 (together with the other provisions of that Act that are applied in that Part) applies to the appeal— (a) so far as it is applicable and with all necessary modifications; but (b) only so far as it relates to appeals on questions of law. (4) Subsection (3) overrides subsection (2) .
