Section 362A — Building Act 2004: Premises in respect of which duty arises under section 363

362A Premises in respect of which duty arises under section 363 (1) This section applies to premises that— (a) are intended to be open to members of the public or are being used by members of the public; and (b) comprise all or part of a building. (2) For the purposes of subsection (1) , premises may be intended to be open to members of the public— (a) whether or not members of the public are charged for their use (or, as the case may be, whether or not it is intended that members of the public are to be charged for their use); and (b) whether or not members of the public will, regularly or from time to time, be excluded from them. Section 362A was inserted, as from 14 April 2005, by section 22(1) Building Amendment Act 2005 (2005 No 31).
