Section 58 — Building Act 2004: Liability to pay levy: building consent authority

58 Liability to pay levy: building consent authority (1) A building consent authority, on the grant of a building consent, becomes liable to the territorial authority for the levy payable under section 53 in relation to the building work to which the building consent relates. (2) A building consent authority must pay the levy to the territorial authority at the same time that it provides, under section 238(2)(d) , copies of information about the collection of that levy. (3) A person commits an offence if the person fails to pay the levy in accordance with this section. (4) A person who commits an offence under this section is liable to a fine not exceeding $5,000. Compare: 1991 No 150 s 23C(1) Subsection (1) was amended, as from 14 April 2005, by section 7(2)(b) Building Amendment Act 2005 (2005 No 31) by substituting the word “ grant ” for the word “ issue ” .
