Section Sch3-19 — Building Act 2004: Confidentiality of information

19 Confidentiality of information (1) A member who has information in his or her capacity as a member that would not otherwise be available to him or her must not disclose that information to any person, or make use of, or act on, that information, except— (a) for the purposes of the Board; or (b) as required or permitted by law; or (c) in accordance with subclause (2) ; or (d) in complying with clauses 16 and 17 . (2) A member may disclose, make use of, or act on the information if— (a) the member is first authorised to do so by the Board; and (b) the disclosure, use, or act in question will not, or will not be likely to, prejudice the Board.
