Section 80 — Care of Children Act 2004: Taking child from New Zealand

80 Taking child from New Zealand Every person commits an offence and is liable on summary conviction to a fine not exceeding $2,500, or to imprisonment for a term not exceeding 3 months, or to both, who, without the leave of the Court, takes or attempts to take any child out of New Zealand— (a) knowing that proceedings are pending or are about to be commenced under this Act in respect of the child; or (b) knowing that there is in force an order of a Court (including an order registered under section 81 ) giving any other person the role of providing day-to-day care for, or contact with, the child; or (c) with intent to prevent an order of a Court (including an order registered under section 81 ) about the role of providing day-to-day care for, or about contact with, the child, from being complied with.
