144 Agreement not to be made without consent of child or young person (1) Subject to subsection (2) of this section, no agreement shall be made under section 140 or section 142 of this Act with respect to— (a) A child of or over the age of 12 years; or (b) A young person— unless that child or young person consents in writing to the making of the agreement. (2) The consent of a child or young person to whom section 142 of this Act applies is not required under subsection (1) of this section if the child or young person is unable, by reason of that child's or young person's disability, to understand the nature of the agreement. (3) Before an agreement is entered into under section 140 or section 141 or section 142 of this Act, the wishes of the child or young person shall, where practicable, be ascertained and given due consideration in concluding the terms of the agreement.
