Section 198 — Children, Young Persons, and Their Families Act 1989: Special provisions applying to applications for declaration on ground of child's offending

198 Special provisions applying to applications for declaration on ground of child's offending (1) The Court shall not make a declaration under section 67 of this Act on the ground specified in section 14(1)(e) of this Act unless— (a) It would have found the child guilty of an offence if the proceedings had been pursuant to an information laid under the Summary Proceedings Act 1957 charging the child with the offence; and (b) The Court is satisfied that the child knew either that the act or omission constituting the offence was wrong or that it was contrary to law. (2) Nothing in section 195 or section 197 of this Act applies to any proceedings for a declaration under section 67 of this Act on the ground specified in section 14(1)(e) of this Act.
