Section 43 — Children, Young Persons, and Their Families Act 1989: Placement of child or young person placed in custody of chief executive

43 Placement of child or young person placed in custody of chief executive (1) Subject to subsection (2) of this section, where a child or young person is placed in the custody of the chief executive pursuant to section 39 or section 40 or section 42 of this Act, the chief executive may place the child or young person with— (a) A parent or guardian of the child or young person; or (b) Any other person who previously had the care of the child or young person; or (c) Any member of the child's or young person's family, whanau, or family group; or (d) Any person approved by a Social Worker. (2) If it is not practicable or appropriate to place the child or young person with any of the persons specified in any of paragraphs (a) to (d) of subsection (1) of this section, the chief executive may place the child or young person in a residence. (3) Where a child or young person is placed in the custody of the chief executive pursuant to section 39 or section 40 or section 42 of this Act, the chief executive may, at any time, release the child or young person from that custody. Section 43 was amended, as from 1 October 1999, by section 13 Department of Child, Youth and Family Services Act 1999 (1999 No 82) by substituting “ chief executive ” for “ Director-General ” .
