46 Powers of Court where application made under section 44 or child or young person brought before Court under section 45 Where an application is made to the Court under section 44 of this Act, or a child or young person is brought before the Court pursuant to section 45 of this Act, the Court may— (a) Make an order— (i) Directing that the child or young person be released from custody; and (ii) subject to any order in force under the Care of Children Act 2004 and relating to who has the role of providing day-to-day care for the child or young person, directing that the role of providing day-to-day care for the child or young person be exercised by any person the Court thinks fit: (b) If an application for a declaration under section 67 of this Act has been made in respect of the child or young person, make an order under section 78 of this Act relating to the custody of the child or young person pending the determination of the application: (c) Make any order that it is empowered to make under section 121 of this Act. Paragraph (a)(ii) was substituted, as from 1 July 2005, by section 151 Care of Children Act 2004 (2004 No 90).
