Section 71 — Children, Young Persons, and Their Families Act 1989: Court may make declaration in absence of proof of responsibility for neglect or ill-treatment of child or young person

71 Court may make declaration in absence of proof of responsibility for neglect or ill-treatment of child or young person Where— (a) An application for a declaration that a child or young person is in need of care or protection is made on any of the grounds specified in paragraph (a) or paragraph (b) of section 14(1) of this Act; and (b) The Court is satisfied that, but for the failure of the evidence to establish that a parent or guardian of the child or young person or a person having the care of the child or young person is culpable in relation to the harm suffered by the child or young person, the grounds for making the declaration are made out,— the Court may find those grounds made out.
