Section 375 — Companies Act 1993: Proceedings for offences

375 Proceedings for offences (1) The offences specified in— (a) Subsections (1) , (2) , and (3) of section 373 of this Act; and (b) Section 374 of this Act— are triable summarily. (2) The offences specified in subsection (4) of section 373 of this Act are triable on indictment. (3) Notwithstanding anything to the contrary in the Summary Proceedings Act 1957 , any information for an offence referred to in subsection (1) of this section may be laid at any time within 3 years after the date of the offence. (4) Nothing in sections 377 to 380 of this Act affects the liability of any person under any other Act, but no person shall be convicted of an offence against any of those sections and a provision of any other Act in respect of the same conduct.
