57 Application may not be made in certain circumstances (1) A debtor may not make an application under section 55 if— (a) the debtor has defaulted in a payment; or (b) the debtor has caused a credit limit to be exceeded; or (c) it was reasonably foreseeable to the debtor at the time the contract was made that the debtor would be unlikely to be able to meet his or her obligations under the consumer credit contract because of the illness, the injury, the loss of employment, the end of the relationship, or the other reasonable cause. (2) However,— (a) subsection (1)(a) does not prevent an application being made if the debtor has remedied the default (to the extent that it can be remedied); and (b) subsection (1)(b) does not prevent an application being made if the credit limit is no longer exceeded.
