Section 90 — Credit Contracts and Consumer Finance Act 2003: Enforcement of statutory damages

90 Enforcement of statutory damages (1) The Court may, on the application of the Commission or any party to a consumer credit contract, guarantee, consumer lease, or buy-back transaction, make an order directing a creditor, a lessor, a transferee, or a buy-back promoter to pay any statutory damages that are payable under section 88 . (2) An order under subsection (1) may be made whether or not any person has suffered, or is likely to suffer, any loss or damage as a result of the breach referred to in section 88 . (3) An application under this section may be made at any time within 3 years from the time when the matter giving rise to the application occurred. (4) An application by the Commission under this section may be made by the Commission on behalf of a person or a class of persons.
