Section 130 — Crimes Act 1961: Incest

130 Incest (1) Sexual connection is incest if— (a) it is between 2 people whose relationship is that of parent and child, siblings, half-siblings, or grandparent and grandchild; and (b) the person charged knows of the relationship. (2) Every one of or over the age of 16 years who commits incest is liable to imprisonment for a term not exceeding 10 years. Subsection (1)(b) was amended, as from 1 January 1970, by section 12(2) Status of Children Act 1969 (1969 No 18) by omitting the words “ and whether the relationship is traced through lawful wedlock or not ” . Subsection (3) was repealed, as from 1 January 1970, by section 12(2) Status of Children Act 1969 (1969 No 18). Section 129A was substituted, as from 20 May 2005, by section 7 Crimes Amendment Act 2005 (2005 No 41). See sections 12 and 13 of that Act for the transitional provisions.
