Section 307 — Crimes Act 1961: Threatening to destroy property

307 Threatening to destroy property (1) Every one is liable to imprisonment for a term not exceeding 3 years who sends or causes to be received, knowing the contents thereof, any letter or writing threatening to destroy or damage any property, or to destroy or injure any animal. (2) Nothing shall be an offence against subsection (1) of this section unless it is done without lawful justification or excuse, and without claim of right. Compare: 1908 No 32 s 343; 1941 No 10 part Schedule Subsection (2) was amended, as from 1 October 2003, by section 16 Crimes Amendment Act 2003 (2003 No 39) by substituting the words “ claim of right ” for the words “ colour of right ” .
