Section 336 — Crimes Act 1961: Indictment for treason

336 Indictment for treason (1) Every indictment for treason must state overt acts, and no evidence shall be admitted of any overt act not stated unless it is otherwise relevant as tending to prove some overt act stated. (2) The power of the Court to amend an indictment under section 335 of this Act shall not extend to authorise the Court to add to the overt acts stated in the indictment. (3) Nothing in subsection (2) of this section limits anything in section 345C of this Act. Compare: 1908 No 32 s 393 Subsection (2) was amended, as from 1 March 1996, by section 4(1) Crimes Amendment Act (No 2) 1995 (1995 No 68) by inserting the words “ under section 335 of this Act ” . See clause 2 Crimes Amendment Act Commencement Order 1996 (SR 1996/1). Subsection (3) was inserted, as from 1 March 1996, by section 4(1) Crimes Amendment Act (No 2) 1995 (1995 No 68).
