Section 373 — Crimes Act 1961: Adjournment

373 Adjournment (1) From the time when the accused is given in charge to the jury the trial shall proceed continuously, subject to the power of the Court to adjourn it. (2) Upon every such adjournment the Court may, if it thinks fit, direct that during the adjournment the jury shall be kept together, and that proper provision be made for preventing the jury from holding communication with any one on the subject of the trial, but, if no such direction is given, the jury shall be permitted to separate. (3) [Repealed] (4) [Repealed] Compare: 1908 No 32 s 430 Subsection (2) was amended, as from 1 January 1967, by section 7(2) Crimes Amendment Act 1966 (1966 No 98) by inserting the words “ but, if no such direction is given, the jury shall be permitted to separate ” . Subsections (3) and (4) were repealed, as from 1 January 1967, by section 7(1) Crimes Amendment Act 1966 (1966 No 98).
