172 Goods must be sold by public auction unless court orders otherwise (1) Goods seized under a warrant to seize property must be sold by public auction unless a court orders otherwise. (2) A bailiff who is authorised to execute a warrant to seize property may, if he or she first obtains the Registrar’s written approval (which may be given by email or other electronic means), sell goods seized under the warrant without the necessity of taking out an auctioneer’s licence. (3) Subsection (2) overrides any enactment or rule of law to the contrary. (4) The jurisdiction of a court under this section may be exercised by the Registrar. Compare: 1947 No 16 s 89
