Section 188 — District Court Act 2016: Registration of charging order over land or mining privilege

188 Registration of charging order over land or mining privilege (1) This section applies when a charging order is made in respect of the registered estate or interest of the judgment debtor in land. (2) The order may, on receipt of a duplicate or copy of the order under the seal of the court,— (a) be registered by the Registrar-General of Land, if the title to the land is under the Land Transfer Act 1952 ; or (b) be registered by the appropriate Registrar of Deeds, if the title to the land is not under the Land Transfer Act 1952 ; or (c) be recorded, in the case of a mining privilege under the Mining Act 1971, by the Registrar-General of Land. (3) There must be no charge for the registration or recording of the charging order. Compare: 1947 No 16 s 96A(5), (6)
