Section 197 — District Court Act 2016: Irregularity or informality in execution of warrant

197 Irregularity or informality in execution of warrant (1) A person ( A ) who applies for the issue of a warrant for the recovery of land and is lawfully entitled to possession of the land at the date of issue of the warrant is not liable as a trespasser by reason only of any irregularity or informality in the execution of the warrant. (2) A person aggrieved by an irregularity or informality in the execution of a warrant for the recovery of land may sue A only for special damage, and, if the special damage proved is not more than $30, the person is not entitled to costs, unless the court orders otherwise. (3) In subsection (1), A includes A’s agent or another person acting on A’s behalf. Compare: 1947 No 16 s 100
