Section 26 — District Court Act 2016: Acting Chief District Court Judge

26 Acting Chief District Court Judge (1) The Chief District Court Judge may, with the concurrence of the Chief Justice, nominate a Judge to act in place of the Chief District Court Judge for any period during which— (a) the office of the Chief District Court Judge is vacant; or (b) the Chief District Court Judge is absent from New Zealand; or (c) the Chief District Court Judge is unable for any reason (including illness) to perform the duties of the office. (2) The Chief Justice may nominate a Judge to act in place of the Chief District Court Judge for any period during which the Chief District Court Judge is unable for any reason (including illness) to perform the duties of the office. (3) For the period of his or her appointment, the Acting Chief District Court Judge is empowered to perform the functions and duties, and to exercise all the powers, of the office of Chief District Court Judge.
