Section 56 — District Court Act 2016: Acting Chief Community Magistrate

56 Acting Chief Community Magistrate (1) The Governor-General may, on the advice of the Minister, appoint a Community Magistrate to act in place of the Chief Community Magistrate for any period during which— (a) the office of the Chief Community Magistrate is vacant; or (b) the Chief Community Magistrate is absent from New Zealand; or (c) the Chief Community Magistrate is unable for any reason (including illness) to perform the duties of the office. (2) For the period of his or her appointment, the Acting Chief Community Magistrate is empowered to perform the functions and duties, and to exercise all the powers, of the office of Chief Community Magistrate.
