Section 81 — District Court Act 2016: Extension of jurisdiction by consent

81 Extension of jurisdiction by consent (1) This section applies to a proceeding (including a proceeding in admiralty) that, apart from this section, the court would not have jurisdiction to hear and determine because the amount of the claim or the value of the property or relief claimed or in issue exceeds the monetary limit of the court’s jurisdiction. (2) If the parties to the proceeding or to a counterclaim in the proceeding consent,— (a) the monetary limit of the court’s jurisdiction is extended, for the purposes of the proceeding, to the limit of the amount of the claim or the value of the property or relief claimed; and (b) the court may hear and determine the proceeding on that basis.
