86 Transfer of proceeding in which amount or value of claim exceeds $90,000 (1) This section applies to a proceeding in which the amount of the claim or the value of the property or relief claimed or in issue exceeds $90,000. (2) A defendant in the proceeding may by notice require that the proceeding be transferred to the High Court. (3) On receipt of the notice, a Judge must order that the proceeding be transferred to the High Court. (4) This section does not apply to a proceeding for the recovery of land, unless a Judge certifies that, in the Judge’s opinion,— (a) an important question of law is likely to arise; or (b) a question of title to a hereditament is likely to arise other than incidentally.
