90 Transfer of proceeding if no jurisdiction (1) A Judge may order the transfer of a proceeding for which the court does not have jurisdiction to the High Court or to another court that has jurisdiction. This subsection is subject to subsection (2). (2) A Judge may strike out a proceeding if satisfied that the claimant knew or ought to have known that the court did not have jurisdiction to hear and determine the proceeding. (3) A Judge who strikes out a proceeding under subsection (2) may award costs as if the court did have jurisdiction and the claim failed. Compare: 1947 No 16 s 44
