Section 92 — District Court Act 2016: Transfer of summary judgment applications to High Court

92 Transfer of summary judgment applications to High Court (1) Subject to subsection (2), a Judge may, on the application of a party to a summary judgment application made in the court or on the Judge’s own initiative, order that the summary judgment application or a matter arising in the summary judgment application be transferred to the High Court. (2) A Judge may make the order if the Judge is satisfied that an important question of law is likely to arise. (3) The High Court may— (a) hear and determine the summary judgment application or a matter arising in it; or (b) refer the summary judgment application or a matter arising in it back to the District Court with any directions that the High Court thinks fit.
