Section 98 — District Court Act 2016: Minors

98 Minors (1) Any minor who is or has been married or in a civil union may be a party to a proceeding in contract or tort in his or her own name. (2) A judgment in a proceeding under subsection (1) may be given and enforced in the minor’s own name. (3) In this section, minor means a person who is under the age of 18 years. (4) Any minor who is or has been married or in a civil union and any person over the age of 18 years but under the age of 21 years may make or be a party to an application under section 8 of the Domestic Actions Act 1975 without a next friend or guardian ad litem . (5) The court may make orders on an application referred to in subsection (4), and proceedings to enforce an order may be taken, in the minor’s own name. Compare: 1947 No 16 s 50
