Section 100F — Employment Relations Act 2000: Code of good faith for employment relationships in relation to provision of services by New Zealand Police

Text of the provision Official document

100F Code of good faith for employment relationships in relation to provision of services by New Zealand Police (1) Schedule 1C contains a code of good faith for employment relationships in relation to the provision of services by the New Zealand Police. (2) The code— (a) applies subject to the other provisions of this Act and any other enactment; and (b) in particular, does not limit the application of the duty of good faith in section 4 in relation to the New Zealand Police. (3) Compliance with the code does not, of itself, necessarily mean that the duty of good faith in section 4 has been complied with. (4) It is a breach of the duty of good faith in section 4 for a person to whom the code applies to fail to comply with the code. (5) This section does not prevent a code of good faith approved under section 35 or a code of employment practice approved under section 100A applying to employment relationships in relation to the provision of services by the New Zealand Police. (6) However, in the case of any inconsistency, the code set out in Schedule 1C prevails over a code approved under section 35 or 100A . Section 100F: inserted, on 1 October 2008, by section 120 of the Policing Act 2008 (2008 No 72).
